Customers Matter Terms & Conditions
1. Definitions
1.1. The Customers Matter Panel Website is referred to as “The Website” and “The Panel”. “You” or “Your” means any person who is registered with, and participates in, The Panel (a “Participant”). Sainsbury’s Bank and Maru/edr plc together are referred to herein as “We”, “Us” “Their” or “Our”. These Terms & Conditions, in their entirety are referred to as “Terms & Conditions” and “Terms”. “Research” refers to any activity which may be undertaken as part of The Panel, examples include participating in questionnaires, polling and focus groups.
2. Introduction
2.1. Sainsbury’s Bank plc, Registered Office, 33 Holborn, London EC1N 2HT (registered in England and Wales, no. 3279730) has retained Maru/edr plc, Registered Office, The HUB, Berrywood Business Village, Tollbar Way, Hedge End, Southampton. SO30 2UN ("Maru/edr") to manage the Customers Matter Panel (“Panel”).
2.2. By agreeing to join The Panel You agree to be bound by these Terms so please read them carefully. We reserve the right to amend the Terms at any time by posting changes online. As a Participant it is Your responsibility to review the Terms regularly to ensure that You are aware of any changes made and that You agree to them. Your continued participation in the Panel after changes are posted will constitute an affirmative acknowledgement of any modification and Your continued agreement to be bound by the modified Terms.
3. Participant Registration and Use
3.1. To be a Participant in the Panel, You must:
- Be a resident in the UK
- Be aged 18 years or above
- Not be an employee of Sainsbury’s Bank, Maru/edr plc or any associated company
- Not work in advertising, marketing or market research
- Register as a member of The Panel and provide true and accurate information on Your profile and keep that information updated
- Provide true and accurate information in response to the questionnaires You receive. If You provide information that is untrue or inaccurate, or We have grounds to suspect that such information is untrue or inaccurate, We reserve the right to suspend or terminate Your current access to the Panel
3.2. As a Participant You will receive invitations to participate in online Research. You will be invited to participate in feedback and provide Your responses online.
3.3. Your participation in all Research is voluntary and You may cease to be a Participant at any time. You can unsubscribe from the Panel by visiting the Website or by using the link in email invitations.
3.4. To thank You for participating in the Panel, on completion in full of an online feedback form, You will gain an entry into a monthly prize draw (see Prize Draw Terms and Conditions).
4. Use of the Website
4.1. Our Website is made available free of charge. Access to The Website is permitted on a temporary basis and We reserve the right to withdraw, suspend or amend any aspect or feature of The Website without notice.
We will not be liable to You if for any reason our Website is unavailable at any time or for any period.
You are responsible for making all arrangements necessary for You to have access to our Website.
4.2. By submitting Your contribution to The Website or in any other form, You warrant that Your contribution:
- Does not contain any derogatory, offensive, indecent, inappropriate or defamatory material
- Does not infringe any third party intellectual property rights or rights of privacy
- Does not contain any computer virus, or other form of malicious computer code which would disable, disrupt , harm or impede The Website or any software, hardware or data owned or operated by Us
- Complies with all applicable laws and regulations including, without limitation, data protection and privacy laws
4.2.1. The content of “Customers Matter” is protected by copyright, trade marks, database and other intellectual property rights. You may retrieve and display the content of Customers Matter on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the Customers Matter website without written permission from Sainsbury’s Bank.
4.3. If You breach any of the warranties above We have the right to remove You from The Panel and to exclude you from the monthly prize draw.
5. Monthly Prize Draw Terms & Conditions
5.1. On completion of a Customers Matter project each panellist will gain an entry into the monthly prize draw to win a Sainsbury’s gift card to the value of £75 (first prize) or three runner up prizes to the value of £25 each. Each separate project that is completed counts as one entry into the prize draw. One entry per project will be recorded, multiple submissions of the same project will not result in additional entries into the prize draw. Alternatively, click here to enter the prize draw if you do not wish to participate in Customers Matter projects or polls.
5.2. There is a maximum of one prize per Participant per month. However Participants may potentially win a prize on successive months.
5.3. Each monthly prize draw covers a period of one calendar month, starting from 00.00 on the 1st of each month and finishing after 23.59 on the last day of the month. All responses collected within that time period will be eligible for that month’s prize draw.
5.4. The prize draw will take place 7 days after the end of each monthly prize draw period, on the 7th day of the following month. If this date falls on a weekend (Saturday or Sunday) or is affected by a bank holiday or other unforeseen event the date will move to the next available working date. The winner will be picked at random in an electronic draw.
5.5. Prize draw winners will be contacted by email, by the Customers Matter Panel team within 14 days of the prize draw taking place. We may ask You to provide a postal address so that We can send the prize to You. It is Your responsibility to ensure that You accept any prize you win in accordance with these Terms. In the event that You are unable to do so We reserve the right to re-award the prize to another eligible Participant and you will forfeit your right to the prize.
5.6. If the Prize is not claimed within 28 days of the winner being notified, Sainsbury’s Bank reserves the right to award the Prize to an alternative winner.
5.7. The promoter of our prize draws is Sainsbury’s Bank plc, Registered Office, 33 Holborn, London EC1N 2HT (registered in England and Wales, no. 3279730) (“Sainsbury’s Bank”) and administered by Maru/edr plc of The HUB, Berrywood Business Village, Tollbar Way, Hedge End, Southampton. SO30 2UN ("Maru/edr").
5.8. Entry is free and no purchase is necessary.
5.9. Prize draws are open to Participants.
5.10. The name and UK region of residence of the prize draw winners may be displayed on The Panel homepage and may be obtained by sending a stamped self-addressed envelope to “Customers Matter Panel Prize Draw, The HUB, Berrywood Business Village, Tollbar Way, Hedge End, Southampton. SO30 2UN” within 30 days of the relevant prize draw closing date. By accepting a prize, You agree that You will engage in reasonable publicity which may be used without payment in all and any media including, without limitation, in the promoter’s printed publications, promotional materials, social media and in the advertising of the promoter’s goods or services or on their blog or website.
5.11. All prizes are non-transferable and there is no alternative (cash or otherwise) for any prize in whole or part save that We reserve the right to provide a prize of equal or greater value if a named prize is unavailable for any reason.
5.12. Entry into a prize draw constitutes each Participant’s acceptance of these Terms and the specific prize draw terms and conditions.
5.13. We reserve the right to amend these prize draw Terms and any such amendments shall be published on The Panel website.
